Terms of Use

These Terms of Use (the “Terms”) govern your use of USA Driving Test Prep (the “App”), provided by VolcanoByte (“we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Educational purpose

The App provides educational content and DMV-style practice materials to help users study driving rules, road signs, and related topics. The App is a study aid only. It does not provide legal advice, driving instruction, certification, licensing, or any government service.

2. No government or DMV affiliation

The App is not an official Department of Motor Vehicles (DMV) product and is not affiliated with, endorsed by, sponsored by, or connected to any DMV, motor vehicle agency, licensing authority, or other government entity.

Practice questions and explanations are created for study purposes. They are not guaranteed to be official, current, complete, or identical to questions used on any actual government examination. Official rules and requirements may vary by state and may change over time. Always consult your state’s official driver handbook and government resources.

3. No guarantee of passing

Using the App does not guarantee that you will pass a written, knowledge, permit, license, or driving examination. Results depend on many factors, including your study, judgment, skills, local requirements, and performance on the official test.

4. User responsibility

You are responsible for:

  • verifying current laws, procedures, fees, eligibility rules, and test requirements with the appropriate official agency;
  • using the App safely and lawfully;
  • not using the App while driving or when doing so could create a distraction or safety risk; and
  • making your own decisions based on official information and professional instruction when appropriate.

You must not misuse the App, interfere with its operation, attempt unauthorized access, reverse engineer it except where permitted by law, or use its content for unlawful purposes.

5. App access and local data

The App does not require an account. Progress and preferences may be stored locally on your device. You are responsible for maintaining access to and backups of your device. We do not guarantee that locally stored progress will always be available, recoverable, or transferable.

We may modify, suspend, or discontinue any part of the App, including features and content, when reasonably necessary.

6. Premium features, subscriptions, and purchases

The App offers paid Premium features, one-time purchases, and may offer automatically renewing subscriptions. The price, billing period, trial terms, included features, and renewal information are shown before purchase in the App Store or Google Play. Premium access removes ads and unlocks Premium features, including higher or unlimited usage limits and expanded study insights, as described in the App at the time of purchase.

Purchases may be processed through Apple, Google, and RevenueCat. Payment is charged by the applicable app store, not directly by VolcanoByte. Subscription management, cancellation, and refund eligibility are governed by the applicable store’s terms and settings. Unless the store states otherwise, deleting the App does not cancel a subscription.

7. Advertising

The App displays advertising to Free users through third-party advertising partners such as Google AdMob. Premium users do not see ads. Additional disclosures or consent choices may be presented as required. The presence of an advertisement does not mean that VolcanoByte endorses the advertised product or service.

8. Intellectual property

The App, including its software, design, branding, original questions, explanations, graphics, and other content, is owned by or licensed to VolcanoByte and is protected by applicable intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial study. You may not copy, sell, redistribute, publish, sublicense, scrape, or create derivative works from the App or its content except with our prior written permission or as allowed by law.

Third-party names, trademarks, and materials remain the property of their respective owners.

9. Disclaimer and limitation of liability

To the maximum extent permitted by law, the App is provided “as is” and “as available.” We do not make warranties that the App will be uninterrupted, error-free, complete, accurate, or suitable for a particular examination or jurisdiction.

To the maximum extent permitted by law, VolcanoByte and its owners, team members, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses arising from reliance on practice content, examination results, loss of local progress, inability to use the App, or use of third-party services.

Nothing in these Terms excludes rights or liability that cannot legally be excluded or limited.

10. Changes to these Terms

We may update these Terms to reflect changes to the App, future services, legal requirements, or business practices. We may provide an in-app notice when changes are material. Continued use of the App after updated Terms become effective means you accept the revised Terms, to the extent permitted by law.
